It’s a vexed question Terry and I think you summarise the situation and the options very well.

I reckon that it all started when lots of people went somewhere in Asia (before the internet) and bought a pirated movie or a copied bit of music and we all tut tutted but did nothing about it. Because, like you, I am in the business of producing intellectual property I can say (hand on heart) I have never knowingly bought or played pirated material or copied something without the copyright owner's permission.

But I believe I'd be in the minority.

By not taking action earlier we have kind of legitimised this electronic stealing.

So its gunna take real concerted action and education to get the "end stealers" (the users, the people who buy or download our material) to understand that they are stealing... and, boy, that's a huge task.

But just as more and more people understand that we shouldn't rape the environment so as they are educated will they come to understand that we shouldn't pillage intellects.

Terry,
There is not doubt about it something needs t be done to protect the rights of authors and their intellectual property. As a few others have already referred to the concept of this problem needs to be solved by thinking at a higher level. A solution that provides some kind of motivation for people to do the right thing.

Great point, Phil. Perhaps the idea of a "digital dongle" would be appropriate. A user can download the content (whatever it is) but to get the full version (or better version) it requires the authorization which can be obtained from your receipt when purchased. Something along those lines could be the solution. For instance, an MP3 song could be downloaded at poor, say 8-bit, quality. If the user wants to upgrade to full 128K version, it requires a registration code. I'd want to run this by some who are much more knowledgable than me on this but this concept might work with various digital material.

Always good to hear from you, Phil. Thanx for the comments.

Hi Terry,

Well said. I agree with all your comments in the blog. Heavy handed legislation is not the answer.

Here are a few random thoughts.....

It seems that many people believe that 'copyright' means the right to copy. I think that part of the solution is education of consumers that infringing IP is theft and therefore socially unacceptable and wrong. How many of the people who illegally download films and music would be comfortable going into a physical store and shoplifting a DVD? Yes, there are 'bad guys' out there but I believe that society has a role to play.

In olden days there was a device called a dongle. A physical key that unlocked software. In an age of digital downloads it is impractical to require a special bit of hardware to use software. Is there some way of creating a similar idea that you can copy stuff but can't view it without some sort of authentication? Just a thought.

So nice to hear from you, Shelle. Hope you are Misha are doing well. Please give him my regards.

Glad you liked my post. Yes, we must work to secure IP (intellectual property) but it is way beyond the scope of any government. The government in country A can pass a law saying something is illegal. However, if country B doesn't enforce that and people in country B violate that law, their is little that country A can do about it. Ultimately the solution is up to the producers (that's you and me!). We have to be extraordinarily creative and we are doing it now! Whoo Hoo!

Thanx for your comments, Shelle!

This was another case of something that did need to be addressed, but government overreacting with a Draconian measure that would gut the Bill of Rights and invade our privacy. It really did look like a done deal, so it's very encouraging to know that the outcry actually did stop the bill.

Thank you for your comments, Doug,

You raise some good points. Yes, like in the Indiana Jones movie, we are making it up but we also hold some principles sacrosanct. 1) No theft. 2) Freedom of speech, 3) Genuine care for others and their well-being. We're at a point where technology blurs what is possible and that creates some dissonance between points 1 and 2. However, as we "make it up as we go along" strongly guided by these principles, we will arrive at a workable solution. That solution will properly compensates producers fior their intellectual property and preserves the all-important free speech.

By the way, did you get a chance to listen to my enhanced audio of the post? You might find that helpful as well. I'd welcome your comments.

And yes, I firmly agree with your last sentence that technology is moving too fast for the government. That is a good thing. A bumbling leviathan Hobbesian bureaucracy can never hope to keep up with nimble, quick silver-like agility that the free market provides in any culture.

Thanx for your very astute comments, Doug. I look forward to hearing from you more.

some of it is like Indiana Jones in the first movie where, when he was asked by the lovely maid as he was confronting the bad guys, “Indiana, what are you gonna’ do?” His reply? ”I don’t know. I’m making this up as I go.”

Is that not stealing intellectual property? You are using it to make a point. You are using it without their permission. This has always been the case, its what we do as humans. Its like telling a joke that you made up, sooner or later (if its a good joke) it is repeated.

I for one dont like the fact that many speakers such as yourself are limiting the amount of content on YouTube of your speeches. I utilize YouTube to pick the speaker for my next conference. Just a little thing, but thats what I use it for.

I think technology is moving too quickly to be able to control through the Government. It has to be the person creating the content. You have to be smarter than your competitors.

Hi amigo Terry,
Excellent blog this morning. I had been thinking... yes but what about us who produce intellectual content? If not the sledgehammer approach, then what? So part of me is relieved that we are all just making it up as we go along and another part is reassured that if we do get it wrong, we will surely hear about it! And another part doesn't know what it's talking about anyway.

Your blog added a lot of clarity for me.
Hugs from Berlin,
Shelle

Thank you very much for your reply, Steve. I hear you loud and clear. I'm also an author of books and have seen this happen. We are agreed that we need to protect IP (Intellectual Property) for all works. However, SOPA was not the way to do it. They would shut down whole websites without question. Oh, and then there's that "not guilty till proven innocent" thingy we have in America. That cumbersome "right to trial by jury" just seems to have been overlooked with SOPA.

Yes, we need laws, but we also have to realize the reality of a world where laws in American just somehow don't matter to many in other countries. We, as creators have to adapt and come up with other ways to foil the bad guys who want to steal and we have to do it 1) peacefully, and 2) without relying on an incompetent government (but, I'm redundant). That is the point that we have to address the issue in a 21st Century way ---- not in a 17th Century manner. Protection of your IP? Absolutely. It is axiomatic! SOPA? No way. Let's come up with better, more creative, more "bad guy stopping" ways that halt them in their tracks. There are ways to do that. Let's continue the exploration. Thank you SO much for your comments, Steve. I look forward to hearing from you more.

Yes, Diane. We understand why they wanted it but they went about it the wrong way. Much too heavy-handed and it hurts much more than it will help any struggling producer of content. Thanx for sharing, Diane!

Thank you, Al. Yes, it seems this is what often happens regardless of the government anywhere in the world. They really, really really try (notice the emphasis?) to do the right thing. But, because human nature is what it is, inevitable problems emerge from a top-own government-imposed "solution." Thanx for sharing and Look forward to hearing from you many more times in the future.

"Government usually starts with very good intentions and ends up with very bad results because of unintended consequences."

A thousand years from now, people will be quoting the venerable philosopher, Terry Brock.

Terry, in that quote, you have summed up the fate of government. Fortunately, we live in a part of the world where our government, no matter how flawed, is still the best man can find.

We have to remember your quote and let our voices be heard so these minor course corrections happen.

Thank you, Terry.

Thanks Terry. The headings of the bill which suggest copyright protection is the objective seem harmless enough. Having experienced the havoc wreaked upon songwriters by the unrestricted downloading of music without consideration of royalty fees, etc. I'm all for protecting copyright.

But after having read some of the comments by bloggers at the links you offered, I can see where the concerns are. It's probably better to have no legislation (if it could end up infringing or hindering free expression) than to give government the authority to shut down sites they may someday find politically distasteful.

I, too, am a creator of books, audio programs, systems, and other forms of intellectual property. When someone steals my material, it's the equivalent of being robbed of income and, potentially, my livelihood.

What you're saying in your post -- "theft is wrong", "we have to adapt" to the "reality" of things -- isn't much of a solution. Why do you not want a strong law in place, a law with real teeth, that protects content creators like us?

Consider this example: One of my ebooks is currently being distributed by an overseas "file sharing" website. (Without my permission, of course.) As soon as it became available on that site, sales of my ebook dropped to almost zero. We tried repeatedly to contact the website owners -- information not easy to find, by the way -- but got no response.

So it's not just big Hollywood studios that are impacted by IP theft. It's also thousands of hardworking creative entrepreneurs, like you and me.

Solid recommendations for me. I like the idea of focusing on the activities that really are a value to my career goals. It means stopping some of the professional relationships that are just fun and are not helping me reach my career targets. Thanks for being there.

Onyer Terry and its fantastic to see what you are offering. I know the impact you have had on so many of my clients (and me) out here in Australia... you're making sure that they are light years ahaead of their competition.

I thought though I should ask whether there is a mistake! Are you sure that you have the price right? Surely people can't get all those goodies for such a small investment!

Hi Terry,

You may remember me from our contacts at CAPS Calgary. It was great to watch you again tonight. I have put my simple approach to teaching parents how to coach their struggling readers that I talked to you about, into an online eLearning course. You said you might have some people who would be interested in it. Do you still have some contacts with people who work with students who don't read well?
I am planning on getting my marketing material out by mid-January. This is the hard part. I just turned 77 years old and I'm working harder than ever at teaching an old dog new tricks (me!). Wish I had your marketing knowledge but I do have a small group who will help me. Best regards, Vera.

I am extremely impressed together with your writing talents as smartly as with the format on your blog. Is this a paid theme or did you modify it your self? Either way keep up the excellent quality writing, it is rare to look a great weblog like this one today..

I dunno Terry whether responding belatedly so long after you have posted an article is of value but as you will realise I have been somwhat tied up with the celebrations.

But I do just want to put on record what a great friend and mentor you have been to me over the many years I have known you. You have dragged me, sometimes kicking and screaming, into the digital age by making things simple, easy to understand and practical.

And a variation of your tips for a great day... 3 chapters, 3 miles of exercise and 23 minutes of meditation sets me up for a great day every day.

What's that old saying... "If you're ripe you're rotten; if you're green you're growing". You have fertilised, watered and pruned me so that I have kept growing.

For that I thank you.

P.S. Training the kangaroos to run past only took us a couple of weeks!

Preparedness Meets Opportunity, great lesson Terry. There have been times when I’ve been driven to develop an idea without a market. It’s a great idea. I don’t know why I’m doing it, but something pulls me to do it. At some point you wonder why you’re called in a certain direction but then suddenly you crash head-on into the “objective of your purpose.” The market materializes and boom; preparedness meets opportunity. Thanks again for fomenting discussion.

I love your observations on Toxic Relationships, Terry. Especially the quote: “Sometimes, when you give up on someone, it’s not because you don’t care anymore, but because you realize they don’t.”

For most of us,there are people, inside and outside of work who may be draining the life out of us. Who we invest our time with is a choice and that choice may determine our health and happiness as well as the profitability of our business.

Terry--

Very timely. A friend and I were just reviewing the two Boards of Directors we are serving for the second year. One we will continue and one we will allow to move forward without us...making room to serve another that can really benefit from our time, energy and commitment!

Thanks for sharing!

Terry,

Great story and reminder to get the right resources and turn it around. I recently had a friend say, "You are sure . . . persistent." I suspect he offered it as a minimal compliment, lacking exuberance about my late blooming success. He seemed to believe talent trumps all else but I have found persistence often forgives many shortcomings. Thanks for the reminder. Now, I have to get back to work.

Hey Terry, always a great reminder that we're as good as our attitude about our circumstances. It really is how we feel about it, and how we choose our emotions, and that makes all the difference. Thanks as always for such positive messages about what's possible in our lives.

Great message. All through our lives we've had to be resilient. Persistence and resilience are attributes entrepreneurs must make a decision - yes make a conscious decision - to put into practice every single day.

Thank you for your comment, Rick. Yep! One wonders who such a good company that has done so many things right can do something so (to use your words) boneheaded. However, i have to admit that I've done more than my share of "boneheaded" actions in the past. I guess we live and learn. Thanx for your comments.
Hey Terry. You're right on with regard to setting your own pricing. Over my 17 years in crisis management I have made some of boneheaded moves for just the reasons you give. You have to be very very careful about price moves.

As for Netflix, with their size and with so much at stake, I would like to know if they did any serious research with their customers to get some idea of the market reaction. They acted as though they didn't, and that is just dumb.

Always appreciate your insights. Thanks,

Rick

Thanks for the excellent review Terry. I actually do some of these things and will work on the rest.

I was at Gecko Fest in Gulfport, FL (Boca Ciega Bay) this morning and thought of one of your "gizmo" excerpts from VOE. We purchased a trinket from an artisan at the festival and she pulled out her Droid, inserted a little gizmo into the Droid and scanned my payment card. My data and payment was uploaded to her merchant account and then I signed the screen on her Droid and the transaction was executed. I wondered "ooh, does she know Terry Brock?"

My data and payment was uploaded to her merchant account and then I signed the screen on her Droid and the transaction was executed. I wondered “ooh, does she know Terry Brock?”

Greedings from Perth, Australia
Great review and highlighting of the points from the Harvard Business Review article, Terry. There is far too much energy being used up in these challenging times by searching for someone or something to blame for the predicament many businesses find themselves in. Far better to look internally, take some time for reflection, focus on self-improvement and reflect on and celebrate each small success along the way.

By the way, I love how you use your technological knowhow to highlight your message and focus the reader on key points. Someday I'll add that skill to my goals!!!

What a fantastic article for you to "gift" us with as we head into the long weekend! What you say is so true about the external swirl of frustration, fear and hurting that is going on for so many people. During meditation or prayer time, the gift of infinite possibilities and faith in oneself has an opportunity to be discovered and can deliver peace within...even if only for a few moments. Have a safe and peace-filled weekend, Terry!

5 years ago I had to learn how to put names and addresses into the computer at work and I was in tears. When it was time to get my first laptop I asked our computer network guy at work advise regarding windows or Mac.He said unless I'm doing art related work go with windows.I bought my first iPod,then iPhone then IPad then iPhone 4.With the iPad I purchased Numbers,Pages.Something magical happened ... my creativity opened up like pandoras box.It was so easy to be creative with a few clicks and some imagination.I didnt even know I had a creative side.My friends now laugh and call me tecno aly and are in awe when I create an invitation or business cards or poster for them just for fun.I am so thankful for Steve Jobs and Apple the experience has been life changing.

Terry, great post. What I especially appreciate this insight:

"Even more than the business lessons, Steve Jobs helps us to see how we can live life fully, with gusto, going for it and never quitting."

Great parallel for work and life.

Great Post Terry! Steve Jobs is truly a visionary - after recently reading a book called Making Ideas Happen (by Scott Belsky) I learned that there are three categories of people in the world. The Dreamers, the Doers and the Incrementalists. Dreamers are great at generating new ideas, Doers focus on taking action and Incrementalist shift between distinct phases of dreaming and doing. In addition to the outstanding principles you shared, I hope your readers know that to build a great company like Apple or to succeed in our own career, we need to identify which type of person we are as well as identify others who can help us. All 3 types are needed on any project for ultimate success. According to the book "In the leadership of Apple, one might call Jonathan Ive (chief designer), Tim Cook (chief operating officer), and Steve Jobs (chief executive officer) Dreamer, Doer and Incrementalist, respectively. Embrace the 5 lessons eloquently shared by Terry and consider your role towards greatness.

Biggest mistake I see professional people make in the Social Media--posting comments that are at least risky and often risque, regarding personal habits, dating, hygiene, bodiy functions, crude behavior, and similar topics. With me, their credibility nosedives immediately. I love humor as much as anybody, but I also love respect and good manners, especially when addressing a massive audience of people you really don't know. My advice: When in doubt. . .leave it out.

Great food for thought as always Terry. I think that resistance is a personal mental "kick back" reaction to test our resolve... if we don't get that little voice telling us we can't do it then we are easily dissuaded from the task. When we start to doubt our abilities, pride and commitment kick in and strengthen our determination.

Resistance is Normal? I thought that you and your Trekker friends were fond of saying "Resistance is Futile." LOL.

Great article as always. Thanks for keeping us informed about great books like Pressfield's "Do the Work."

I think often of examples like Lindbergh who succeeded despite overwhelming odds. It must have taken incredible fortitude and a real stubborn streak to keep pressing on like he did. The movie, The Spirit of St. Louis is a classic that tells part of the story.

Hey Terry:
How fitting your resistance discussion is today. This weekend Facebook allowed me to rekindle a friendship from 30 years ago when this buddy and I were struggling young fathers.
I’m sure he doesn’t have one credit hour of college training but by starting a drywall business and working extremely hard and smart he’s managed to build an empire with nearly 100 rental properties, a yacht, palatial home, no debt and he sits on the board of banks. On top of that he heads his own rock and roll band (we were both aspiring musicians) and has toured with national acts.

This buddy had his share of resistance starting with an alcoholic father who used his children as punching bags. I think about Billy and what drove him to achieve. I know there was high energy and a great deal of drive but I’ll leave that open for further discussion.

You are right, Joyce. We have to have that blend. Perhaps someday we will see less of the quotes on Twitter and more of people sharing their own thoughts. Quotes are good. News about something important that is happening makes a lot of sense. Hey, we respect the person who has a broader knowledge base than just themselves. But, in serious social media, we have to have a lot more than "all about me" and on the other extreme just a bunch of quotes. Thank you for sharing that, Joyce. Very nice to hear from you! Terry

Winno, you ole' marketing guru, you... You have, once again, hit the nail on the head. In social media we have to share a small portion of us, a soupcon, as you say. I think that has always been the key to success for great leaders. No, you don't tell all the intimate details of your life because, well, frankly, we don't want to know that. HOwever, to know a few details that make you human --- ah, that's the secret! Thank you for sharing that Winno. You are a great mate and I'm honored to know you. Terry

Terry, this is the question that just does not go away! I wish I had an easy answer for you and your readers. I do know that most of us are experimenting on what social networking avenues "seem" to be working for our business. I let clients/prospects know about my professional face book fan page because i want to connect with them on a different level. If they ask me to be friends on face book, I direct them to
facebook.com/conflictresolutionconsultant.

I agree with your bloggers on NOT using other people's quotes on twitter since it tells followers nothing about you...only your favorite philosophers or authors. If everyone is doing this...do something else!

Twitter has been a new challenge...do we add personal or professional info? Lately I have done a bit of both. I tell my followers the new projects I am creating or destinations I will be at just in case they could be in my audience. They are directed to my blog where I include my own quotes/stories/case scenarios. I am having a great time doing this since the response is positive and connections are being made...slowly but it is happening.

I'm looking forward to seeing some interesting results in the future since the potential is great and we all know that being authentic, helpful and even funny are all great characteristics to build smart relationships.

Terry, its a vexed problem I know but my belief is that anything we do... blog, twitter, article, media interview, presentation to an audience, whatever... should always show a little of the real us, the person. In doing so it should reveal a little of our personality and add a soupcon of piquancy, flavour of ourselves, if you will. Not that there isn't any reason, other than our unfortunate oversupply of modesty, for some of us to reveal more than a soupcon!

Thank you, Peter. I agree completely. Politics is a very powerful subject. It affects all of us in some way. HOwever, there is a place for it and a business blog is not necessarily the place. The old sayings about avoiding politics and religion in most polite conversations makes a lot of sense. Thank you for the important reminder. Terry

You betcha, Phyllis! I agree that it is so annoying when all some people do is leave some kind of quote from somebody they probably never met and have no earthly idea of their own. Hey, this is SOCIAL media. Be human. Be real. And yes, be polite and decent as you are in public. You do it so well with your "Firey Retiree" program, Phyllis. You are warm, genuine and real. Thank you for your kind and thoughtful comments. Terry

I just wrote an article about that and don't understand why some people don't get it. I'm especially talking about Facebook. People who only post quotes every day and sometimes many ttimes a day get very annoying. I don't learn anything about that person. There's no personality. I can read my own quotes. I appreciate people who have found a balance so that they share business happenings and personal things. I see a personality there and I bond with that personality. If all a person can do is post quotations, I'll probably drop them. And definitely, a person with a business side, IMHO, should leave the politics and religion elsewhere. As you've always said, Terry....it's all about relationships and why post things that you know are going to offend someone with topics as volatile in those two areas. Thanks for giving me a chance to vent. Balance is the key!

Hi Terry,
Great question. Not that I have any opinion on this, but I do hope all your readers take the time to click through to Matthew Ingram's well reasoned article. I agree with Matthew that this is a social environment, not a billboard environment. It's shocking how many people teach, excuse and practice anti-social behavior on the Internet. You would never ignore someone who talked to you in church. You would never leave out a thank you if someone complimented you at a Kiwanis Club meeting. You would never record ahead of time random thoughts and then upchuck them at a Chamber of Commerce meeting. And yet, when it comes to social media - this kind of behavior is somehow considered acceptable. I agree with Gary Vaynerchuk when he says that 99.5% of all social media experts are clowns. You can see it every day, every hour on every social media site. Just because it's online that doesn't excuse bad behavior. Do what you would do in real life - because the online world is real life. And, read Gary Vee's "The Thank You Economy" - the best short book I've read recently on what social media is all about.
